This End-User License Agreement ("EULA") is a legal agreement between you and Cuisinote ("we," "us," or "our") for the Cuisinote mobile and web application (the "App"). By creating an account and using the App, you agree to be bound by the terms of this EULA.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to the terms of this EULA.

2. User Accounts and Membership

You are responsible for maintaining the confidentiality of your account information, including your password. You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Subscriptions and Payments (Future Feature)

Cuisinote currently offers different membership levels (e.g., L1, L2, L3) at no cost. We reserve the right to introduce fees for certain features or membership levels in the future. We will notify you in advance of any such changes, at which point you will have the option to subscribe to continue using those features.

4. User-Generated Content

You are solely responsible for all recipes, text, images, and other content you upload, post, or import into the App ("User Content").

• Ownership: You retain all ownership rights to your User Content. However, by making a recipe "Public," you grant Cuisinote a worldwide, royalty-free license to display, distribute, and reproduce that specific content within the App and for promotional purposes.
• Responsibility and Copyright: You represent and warrant that you own or have the necessary licenses, rights, and permissions to all of your User Content.
• Prohibited Content: You agree not to upload any User Content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.

5. AI-Powered Import Features

The App provides features to import recipes from web URLs and images ("Import Features"). These tools are provided for your convenience.

• Copyright Compliance: You agree to use the Import Features in compliance with all applicable copyright laws.
• Disclaimer: Cuisinote is not liable for any copyright infringement claims that may arise from your use of the Import Features.

6. Food Safety and Allergy Disclaimer

Cuisinote provides recipes and ingredient suggestions for informational and personal use only. We do not verify ingredient safety, nutritional accuracy, or potential allergens. You are solely responsible for evaluating and ensuring the safety of ingredients, preparation methods, and dietary suitability. Cuisinote is not liable for any health issues, allergic reactions, foodborne illness, or other consequences arising from the use of recipes or information provided in the App.

7. Account Termination

We reserve the right to suspend, disable, or permanently delete your account without warning if you violate the terms of this EULA.

8. Disclaimer of Warranty

The App is provided on an "as is" and "as available" basis, without warranty of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or that any defects or issues will be corrected. You acknowledge that your use of the App is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Cuisinote, its affiliates, or its licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the App.

Under no circumstances will Cuisinote’s total liability to you for all damages, losses, or causes of action exceed the total amount you have paid to Cuisinote in the twelve (12) months preceding the event giving rise to the claim, or ten dollars ($10.00), whichever is greater.

10. Changes to this EULA

We may update this EULA from time to time. We will notify you of any changes by posting the new EULA on this page. Continued use of the App after changes go into effect constitutes your acceptance of the new terms.

11. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. Any legal action or proceeding shall be brought exclusively in the courts located in Fairfax County, Virginia.

12. Privacy Policy

By using the App, you also agree to the terms outlined in our Privacy Policy, which describes how we collect, use, and protect your personal information.

13. Age Requirement

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App.

3. Information Sharing and Disclosure

We do not sell, trade, or rent your personal information to third parties.

• Public Recipes: If you set a recipe to “Public,” its content, along with your display name and avatar, will be visible to other users of the App. Your email address will never be made public.
• Service Providers: We use third-party services such as Firebase (by Google) for database, authentication, and hosting. These services operate under their own privacy policies and are independently responsible for the security and processing of your data.
• Legal Requirements: We may disclose your information if required by law or legal process.

4. AI-Powered Features

Our "Import from Web" and "Import from Image" features use third-party AI services (such as Google’s Gemini) to process content you provide.

• The URLs or images you submit are sent to these services for analysis.
• We do not retain the images submitted for the “Import from Image” feature after processing is complete.
• Use of these services is subject to their respective privacy policies.

5. Cookies and Local Storage (Web Only)

We may use browser cookies or local storage on the web version of the App to maintain your login session and improve functionality. These are not used for advertising or tracking purposes.

6. Data Security

We use administrative, technical, and physical security measures to protect your personal information. While we take reasonable steps to secure your data, no system is completely immune to breaches.

7. Your Data Rights

You have the right to:

• Access and update your account information at any time.
• Delete your recipes and other User Content.
• Delete your account by contacting support or using the deletion tools in the App.
